The Fluffy Standard
The concept of "good faith" comes into play in cases involving contracts in which someone promises to do something that later turns out to be impossible, illegal or otherwise wrong. Professor Lord uses what he calls "The Fluffy Standard" of determining whether or not someone entered into a contract in good faith. He tells of a young woman in his high school class, nicknamed Fluffy for her airheadedness. Fluffy's parents were cruel and strict, and took advantage of their daughter's flighty nature to control and manipulate her. When it came time for young men to begin calling, Fluffy's parents informed her that if she ever kissed a boy, she would become pregnant. At the clinic several months later, a tearful Fluffy took the news of her pregnancy rather poorly, screaming "I NEVER KISSED HIM!" In summary, good faith = a pure heart and an empty head. |
